1. Agreement to Terms

By accessing our website or using the services of Seventh Chakra Healing Ltd. (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.

2. Rental Services

2.1 Rental Agreement

Each rental booking is subject to a separate Rental Agreement, which you are required to read and accept electronically before completing your booking. That agreement constitutes a legally binding contract under the Electronic Transactions Act (SBC 2001, c. 10). A copy is emailed to you upon booking.

2.2 Availability

All equipment rentals are subject to availability. We reserve the right to cancel a booking if equipment becomes unavailable due to damage or servicing, in which case a full refund will be issued.

2.3 Rental Period

The rental period begins on the confirmed delivery or pickup date and ends on the agreed return date. Extensions must be requested at least 24 hours before the return date by calling +1-778-758-1155.

2.4 Pricing and Taxes

All prices are in Canadian Dollars (CAD). Goods and Services Tax (GST) at 5% is applied to rentals, delivery fees, and damage waivers as required by the Excise Tax Act (Canada). British Columbia PST does not apply to short-term rentals of mobility aids and durable medical equipment. Delivery and pickup fees are charged separately and disclosed at checkout.

2.5 Payment

Full payment is collected at the time of booking via Square, our secure payment processor. We accept Visa, Mastercard, American Express, and debit cards. Card data is processed by Square and is never stored on our servers.

2.6 Cancellation Policy

  • More than 24 hours before scheduled delivery: Full refund.
  • Within 24 hours of scheduled delivery: Non-refundable.
  • No-show: Non-refundable.

2.7 Equipment Condition

Equipment is cleaned, disinfected, and inspected between rentals. You are responsible for the equipment during the rental period. You agree to use equipment only for its intended purpose and return it in the same condition as received, subject to normal wear and tear.

2.8 Damage, Loss, and Late Returns

You are responsible for any damage to or loss of rental equipment beyond normal wear and tear. Repair or replacement costs will be charged to you. Late returns are charged at the applicable daily rate for each additional day beyond the agreed return date.

2.9 Damage Waiver

An optional Damage Waiver may be added at checkout. It covers accidental damage during normal use. It does not cover theft, loss, intentional damage, misuse, neglect, or unauthorised modification. The Damage Waiver is not an insurance product.

3. Product Sales

3.1 Availability and Pricing

All sales are subject to product availability. Prices are in CAD and include applicable taxes. We reserve the right to correct pricing errors.

3.2 Returns and Refunds

Product returns are governed by our Shipping & Returns Policy. Please review that policy for eligibility, timeframes, and procedures.

4. Delivery and Pickup

4.1 Service Area

We deliver to addresses within our service area in Metro Vancouver and surrounding communities. Delivery availability and fees are disclosed at checkout.

4.2 Access Requirements

You must ensure clear and safe access to the delivery location. Additional fees may apply for stairs, difficult access, or extended wait times caused by access issues.

4.3 Scheduling

Delivery windows are confirmed by our team. We will contact you approximately 30 minutes before arrival. For rentals, equipment pickup must be scheduled at least 24 hours in advance.

5. Equipment Suitability and Medical Disclaimer

Our equipment is provided as assistive and mobility aids only. We make no medical representations or warranties regarding suitability for any specific medical condition. You are solely responsible for ensuring the equipment meets your needs, and we strongly recommend consulting a qualified healthcare professional before use.

6. Limitation of Liability

To the maximum extent permitted by law, Seventh Chakra Healing Ltd.’s aggregate liability under these Terms is limited to the fees you paid for the specific service in question. We are not liable for indirect, incidental, consequential, or punitive damages arising from your use or misuse of our equipment or services.

7. Indemnification

You agree to indemnify and hold harmless Seventh Chakra Healing Ltd. and its employees from any claims, losses, or damages (including reasonable legal fees) arising from your use of our equipment or services, your breach of these Terms, or your violation of any applicable law.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect and use your personal information in compliance with PIPEDA and BC PIPA.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. The “Last updated” date reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of British Columbia and the laws of Canada applicable therein. Any disputes will be resolved in the courts of British Columbia. You agree to attempt to resolve disputes informally by contacting us before pursuing formal legal action.
